The products in the Lili Margo range (the “ Products ") are offered for sale on the website store accessible at the address http://www.lilimargo.com/fr/ (the “ Website "). This site is published by LILI MARGO, 99 rue Paul Vaillant Couturier, 92240, Malakoff, France (833 348 659 RCS Nanterre) (hereinafter referred to as “ LILI MARGO "). The Lili Margo website store (the “ Shop ") is the official online store for Lili Margo brand products.

The Products that you purchase on the Store are exclusively sold at retail and intended for end consumers. We reserve the right to consider as void any order that does not correspond to a retail sale or to reduce quantities. If you wish to make a purchase in a professional setting, we invite you to contact LILI MARGO by clicking here.

Sales made on this Site are reserved for adults or minors holding authorization from their legal representative allowing them to make a purchase on the Site. We reserve the right at any time to ask you to provide us with proof of identity attesting to your age or authorization from your legal representative. We reserve the right not to fulfill your order if you do not respond to the above request.

We invite you to read these General Conditions of Sale (“ General Terms and Conditions ") as well as the legal notices and conditions of use of the site (available here) and our privacy policy (available here) which govern navigation on the Site as well as the collection and processing of your personal data.

The purchase of Products on the Store requires consultation and full acceptance of these General Terms and Conditions, which you acknowledge having read beforehand. You will therefore be required to actively accept them when placing your order. LILI MARGO reserves the right to modify these T&Cs at any time, the T&Cs applicable to an order nevertheless remaining those applicable at the time of placing said order.

As part of your purchases, we will communicate with you electronically. By using online purchases, you accept that all communication between us takes place electronically and that, unless legal provision requires writing, all our exchanges have the same value as exchanges made by registered mail with acknowledgment of receipt.

1. Our Products

The Products offered for sale and their characteristics are those appearing on the Store. Only this information is deemed valid for the Products. Do not rely on any other website or other source of information for their description.

The Products comply with current French legislation, LILI MARGO cannot be held liable in the event of non-compliance with the legislation of the country in which the Product will be delivered and it is up to you to check with the local authorities of the country of delivery the possibilities of delivery or use of the Products in this country.

2. Your personal account

When you place your first order, you can create a user account with username and password. This is only mandatory if you wish to join our “Ambassador” program (click here to become an Ambassador). It is your responsibility to ensure the preservation and confidentiality of your password, the operations carried out on the Site through your account being deemed to be carried out by you. As soon as you become aware of any misappropriation or unauthorized use of your password, please notify us immediately by clicking here  or by telephone at the number +33 01 80 22 94 86 so that appropriate measures can be implemented.

You will be able to access within your account a summary of the orders you have placed over the last 12 months, your status as it results from our Ambassador program, as well as the sales made by people who have used your promo code and your earnings.

There you will also find your electronic invoices in PDF format. You can print this invoice by going to the “My Activity” section and selecting the order concerned. Please note, an invoice is only available when payment for the order is confirmed.

3. Orders

To place an order you must click on “Add to cart” then go to the checkout page. We inform you that the contents of your basket may be subject to an expiration period. Any order will necessarily constitute unconditional acceptance of these General Terms and Conditions and you must confirm this by checking the appropriate box before validating your basket. Before confirming your order, you have the possibility to check your basket, its total price and the information provided by you, to correct any errors or to make the desired modifications (in particular in terms of Products ordered or quantities appearing in your basket).

For the purpose of making a purchase of Products, you must provide your name and address, telephone number, email address, payment details and any other required information. You will also need to give us a valid delivery address (we do not accept deliveries to post office boxes or automated parcel delivery centers) and be an authorized cardholder or holder of a valid debit/credit card or a valid Paypal account if paying by these payment methods.

You accept that your orders constitute an offer to purchase the Products listed in your order under these General Terms and Conditions. Each order is deemed to constitute a separate sale. All orders are subject to their confirmation by LILI MARGO, which cannot be refused except for legitimate reasons, including in particular a possible fraudulent order or defects.s payment for your previous orders.

4. Processing of orders and Conclusion of the contract

Once your order has been validated, a printable and saveable summary will be displayed on the Site and you will receive an acknowledgment of receipt of your order by email to the email address provided by you. This email will include your identity and contact details, details of the Products ordered, delivery times and possible order restrictions, the amount of the order including taxes, and confirmation of payment. This email does not constitute acceptance of the order, but only confirmation that LILI MARGO has received it.  Acknowledgment of receipt of your order does not in any way guarantee the availability of the products or confirmation of the order.

LILI MARGO retains ownership of the Products until full payment of the price, including shipping costs. In the event of non-payment or payment incident, we reserve the right to ask you to return the products received.

Sales on the Site are made within the limits of available stocks. LILI MARGO does everything possible to ensure that the Products you wish to order from the Store are available.

If a Product is unavailable, you are generally informed directly when placing your order by a message on the Site. However, given the concomitance of orders or links with logistics, it is possible that we will not be able to immediately check the availability of the Products and that we will inform you of this only after validation of your order and before delivery. In this case you will be informed by email.

If the Product you ordered is unavailable, the sale between you and LILI MARGO will NOT be formed in respect of the Product concerned and this Product will not be referred to in the Shipping Confirmation email sent to you. In the event of partial cancellation of your order after it has been placed, you will be delivered the available Products and you will be refunded the price of the unavailable Products ordered as soon as possible and at the latest within 30 days of your payment.

Once you have placed and paid for your order, it cannot be canceled unless you exercise your right of withdrawal in accordance with article 10 below.

5. Prices, Shipping, Fees and Taxes

The prices of the Products appear on the pages presenting each Product and its characteristics when placing your order, in the summary of your order before payment as well as in the email confirming receipt of the order. The prices displayed are all taxes included but exclude shipping and delivery costs.  Unless otherwise stated, all prices displayed on our Store are in euros.

Once the order has been validated and paid, it is sent to the address that you have provided by the postal services or by a specialized service provider (the “ Carrier ") depending on the option you have selected. The amount of shipping costs depends on the delivery location and the shipping method you select.

Shipping and delivery charges will appear on your order before you confirm and pay. You will then have, if necessary, the possibility of modifying your delivery method. Shipping and delivery costs as well as the corresponding VAT will be indicated separately in the order receipt confirmation email. 

Please note that international orders may be subject to customs fees and local taxes, which will be the buyer's responsibility.

6. Payment

Any order placed on the Store implies payment. Orders are payable in euros, all taxes included, and any bank charges remain your responsibility, including in the event of cancellation of the sale.

Payment must be made by credit card (Visa or Mastercard) or Paypal. For credit cards (Visa, MasterCard), “authorization” is required during checkout. An 'authorization' is a check made by your bank to ensure that you have the necessary funds to make the purchase. If the required authorization is not received, LILI MARGO will cancel your order. Payment for your purchase will be deemed to have been made using the bank card concerned once LILI MARGO has sent you the Shipping Confirmation email.

Transactions by credit card or Paypal are secured using advanced encryption technologies.

In any case, LILI MARGO reserves the right to refuse any order in the event of (i) suspicion as to the unprofessional nature of the purchase, (ii) total or partial non-payment of one of your previous orders or of your order.

7. Delivery

The delivery time is mentioned when placing your order. Delivery in France generally occurs within 48 working hours (excluding Saturdays, Sundays and public holidays) from the sending of the Order Receipt Confirmation email, provided that your payment has been received before 3:00 p.m. on the same day of the order. This time frame is given as an estimate. In all cases, the delivery time cannot exceed 30 working days from the sending of the Confirmation email. Receipt of Order. For deliveries abroad, times vary depending on the country of destination.

If the mailbox is missing or insufficient, you will receive a delivery notice informing you of the possibility of collecting your package from a given post office or of contacting the Carrier in order to agree on a new delivery date. You are informed that the retention period of the package by the Carrier is limited to a minimum of 10 days and that after this period the package will be returned to us.

In this case you will be refunded for your order less shipping and delivery costs. The same will apply in the event of an error in the delivery address.

LILI MARGO reserves the right to modify the Carrier responsible for delivering your order and, in this case, no additional costs will be charged to you in relation to your initial request.

Each delivery will be preceded by the sending by email of the corresponding invoice which you can also find in your personal account as indicated in article 2 of these General Terms and Conditions.

LILI MARGO cannot be held responsible for the delay or failure to execute the sale in the event of force majeure, namely in the event of an event beyond its control, including war, act of terrorism, strikes, national or local states of emergency, transport failure, power or service outages, earthquakes or other natural disasters.

If the Products you have received do not correspond to those you ordered, or if your order is incomplete or damaged during transport, you must make all necessary reservations upon delivery and contact LILI MARGO Customer Service by clicking here, by email(sav@lilimargo.com) or by telephone at the number +33 01 80 22 94 86 to obtain any assistance required.

If the maximum delivery time (30 days) is exceeded, you have the option of reporting the order to LILI MARGO Customer Service (sav@lilimargo.com) by email or by telephone at the number +33 01 80 22 94 86 to obtain any assistance required. You will then be reimbursed for your order, delivery costs included, within 14 days of receipt of notification of your order, to the exclusion of any other compensation.

Any delay in delivery must be indicated as quickly as possible to LILI MARGO Customer Service by email. by clicking here or by telephone at the number +33 01 80 22 94 86 so that we can carry out ad hoc research with the Carrier as quickly as possible. If during these investigations, the package is found and unless you have initiated the denunciation of the vote order, the package will be re-directed to the delivery address mentioned in the order. If the order is lost, we will send you a new order at our expense unless the Products are no longer available in which case we will reimburse you.

8. Reception and transfer of risks

Each delivery is deemed to have been made as soon as the Products have been made available to you by the Carrier. The transfer of risks relating to the Products will take place at this time.

It is your responsibility to check the good condition of the package and the conformity of its contents to your order. Any damaged package must be refused by you at the time of delivery and left unopened with the Carrier. You must indicate your refusal and its reasons on the receipt. In the event of delivery by colissimo, you must return the package to the Post Office unopened and expressly report the non-compliant condition of the package to the Post Office within 2 days of receipt of the package. At the same time, you must inform us by clicking here or by telephone at the number +33 01 80 22 94 86 as soon as possible.

Any product missing from your order or damaged must be reported to Customer Service. by clicking here or by telephone at the number +33 01 80 22 94 86. The latter may request any information relating to your identity or that of the recipient of the order and carry out any necessary verification.

9. Legal Guarantees

You have legal guarantees in accordance with the following provisions:

“The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.

“When the contract of sale of the good provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee is applicable to this digital content or this digital service throughout the planned period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date of its appearance.

“The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the property.

“The legal guarantee of conformity gives the consumer the right to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience for them.

“If the item is repaired within the framework of the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

“If the consumer requests repair of the good, but the seller requires replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the good.

“The consumer can obtain a reduction in the purchase price by keeping the goods or end the contract by being reimbursed in full against return of the goods, if:

“1° The professional refuses to repair or replace the goods;

“2° The repair or replacement of the goods takes place after a period of thirty days;

“3° The repair or replacement of the good causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-compliant good, or if he bears the costs of installing the repaired or replacement good;

“4° The non-compliance of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

“The consumer also has the right to a reduction in the price of the good or to the termination of the contract when the lack of conformity is so serious that it justifies the reduction in the price or the termination of the contract being immediate. The consumer is then not required to request repair or replacement of the goods beforehand.

“The consumer does not have the right to cancel the sale if the lack of conformity is minor.

“Any period of immobilization of the good for its repair or replacement suspends the guarantee which remained to run until the delivery of the restored good.

“The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.

“The seller who obstructs in bad faith the implementation of the legal guarantee of conformity incurs a civil fine of a maximum amount of 300,000 euros, which can be increased up to 10% of the average annual turnover (article L. 241-5 of the Consumer Code).

“The consumer also benefits from the legal guarantee against hidden defects in application of articles 1641 to 1649 of the civil code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the item is kept or to a full refund against return of the item. »

10. Right of Withdrawal

10.1 Right of withdrawal

You have 14 days from the day of delivery of your order to withdraw without giving any reason and without penalty with the exception of return costs which will be your responsibility.

The withdrawal period expires 14 days after the day on which you, or a third party other than the Carrier and designated by you, comes into physical possession of the items.

To exercise your right of withdrawal, you must inform us by sending an email to an email to the address service.client@lilimargo.com or a registered letter with acknowledgment of receipt, informing you of your decision to renounce this contract by an unequivocal declaration and of which we will acknowledge receipt by electronic message. You can use the withdrawal form template below, but this is not obligatory.

For the withdrawal period to be respected, it is sufficient for you to send your communication relating to the exercise of your right of withdrawal before the withdrawal period expires.

Please note that you can exercise your right of withdrawal for each Product appearing in your order independently. However, please note that Products sold under the labels “Duo”, “Trio”, “Complete Routine” or “Whole Range” constitute a single product for the purposes of your right of withdrawal. You will therefore only be able to exercise your right of withdrawal for these Products for ALL Products included under these descriptions.

From the moment you receive our message acknowledging receipt of your decision to withdraw, you will then have 14 days to return it to us., at your expense, the complete Productss, in their original, unopened packaging, with intact packaging, accompanied by the return slip sent by email. In the absence of return within the allotted time, the order will be deemed final and no refund can be made except in the cases provided for inx these General Terms and Conditions.

A partial refund will be able to moreover be applied due to a depreciation of the Product(s), resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the Product(s) concerned, in particular due to damage to the original packaging and/or packaging.

10.2 Effects of withdrawal

In the event of withdrawal on your part, we will refund you in full, including delivery costs up to the standard delivery costs (even if you have chosen a more expensive delivery method) and as soon as possible without exceeding 14 days from the day on which we receive the returned Products in original condition. Acceptance or refusal of returned Products will be notified to you by email. We will make the refund using the same payment method that you used for the initial transaction and this refund will not incur any costs for you.

11. Independence of clauses

If one of the stipulations of these T&Cs proves to be unlawful, void or, for any reason whatsoever, inapplicable, this provision will be deemed severable from these T&Cs and this will not affect the validity or applicability of the other stipulations.

12. Limitation of liability

LILI MARGO cannot be held responsible for its obligations under these General Terms and Conditions in the event that their non-performance results from an event constituting force majeure, namely an event meeting the criteria set by the jurisprudence of the Court of Cassation and the legislation, due to the action of a third party even if it is foreseeable or the fault of the buyer.

13. Non-waiver

The fact that one of the parties does not rely on the other party for a breach of any of the obligations referred to in these General Terms and Conditions cannot be interpreted as a waiver of the obligation in question.

These General Conditions of Sale and any sale of Products carried out by LILI MARGO within the Boutique on the Lili Margo site are governed by French law.

16. Dispute resolution

In the event of a dispute likely to arise during the interpretation and/or execution of these Terms or in relation to these General Terms and Conditions, you can decide to resort to conventional consumer mediation, with the mediator designated by LILI MARGO : AME Consumer: https://www.mediationconso-ame.com/

The European Commission also provides consumers with an online dispute resolution platform accessible at the following address: http://ec.europa.eu/consumers/odr/.

In the event of failure of this mediation procedure or if you wish seize a court competent to resolve the dispute concerned, the rules of code of civil procedure will apply.

17. Language

These General Conditions of Sale have been established in French and English. In case of ambiguity, the French version will prevail.
